Title: A question
Post by: Nick on August 14, 2007, 01:01:06 PM
My neghbour's nosey sister keeps going into our garden. I caught her red handed on Sunday. She has just been in there again. She rearranges the plant pots and leaves cat food. She is not senile or otherwise bonkers, just nosey.

Is this trespass? I think so. And would the police do anything if I called them?

Yes it is trespass.

But no the police wouldn't do anything about it as it is not a crime.  It is a tort and as such needs to be addressed in the civil court and will cost.

Additionally, as she is doing no harm the best you could hope for in an injunction prohibiting her from entering the premises which if persistently ignored could eventually lead to an ASBO which if persistently ignored could lead to - Well... You get the picture!

Can't she just tell her straight that she shouldn't do it because - blah blah...

http://en.wikipedia.org/wiki/Trespass

In law, trespass can be:

1.   the criminal act of going into somebody else's land or property without permission of the owner or lessee;
2.   a civil law tort that may be a valid cause of action to seek judicial relief and possibly damages through a lawsuit - see trespass to land.

Set up an archery target at the point at which she enters your property.

Buy The Boy a bow and a quiver of arrows ? introduce him to the art of archery.

Problem solved one way or the other?  whistle:
