Title: Plagiarism
Post by: Nick on September 11, 2007, 09:06:48 AM
Many years ago I edited a book. Gratifyingly, I see that Snoopy actually bought a copy (though he will never ever read it). A lady Professor from the Univ of London subsequently produced a similar book and reproduced my text word for word and comma for comma. I know. She knows I know. I got some very nice hospitality in Oxford (at the Randolph) and some placatory dinners from OUP at the time.

But all she did was to photocopy two years of work and pass it off as her own. I could name her, but it might well be construed as libel*, so  I won't.

Today there is an article in the Guardian. I read it. I also see that I mostly wrote it. But the name on it is not mine. The name on it is that of someone who downloaded it from my website!

* Barman, can I name her?

There are those in the Media who operate on the basis that anything on the internet, unless specifically marked as copyrights reserved, is in fact "in the public domain" and thus they will use it. I found this out when local newspapers picked up on stuff I published in the village magazine and reproduced it under the name of one of their own staff. I now "Reserve all rights" to anything I publish. You could do the same to your web-site .... which at least has the effect of chasing predators away and gives you something to take to a lawyer. Otherwise you don't have a hope in hades.

Write stern letters to the editors in all such cases to date but expect back a reply from an expensive lawyer (that they can afford and you cannot) telling you in legal terms to F*** Off. Then ensure that you copyright everything from now on. As for your book, (i) I have read it ~ it was a struggle but your subject is not one that inspired me and (ii) that is clearly marked as "rights reserved" so get your publishers to seek recompense on your behalf.

Remember that you have to prove an allegation of Plagiarism ~ remember also that to copy from one book is plagiarism, to copy from several is research.

Snoopy is spot on here. I've had similar problems with copyright infringement. It took nine months of legal shenannigans but I could prove it, dated evidence.

They paid up, in full, eventually  8)

Haven't we visited this subject some time before?

I have just finished reading a Court of Appeal judgement that upholds a persons right to break a contract because a remedy wasn't specified by Parliament!

Pick the bones out of that one!   It has just cost me about ?20k  sad24:

Two issues.  One yours, and I'm sure we have 'spoken' of this matter before in another place.

The ?20k loss is my problem.  Having just lost a breach of contract action last week.   It's still hurting...  evil:

Not quite the same thing, but earlier this year I had to monitor someone here who had paid for an essay on the internet to be written/supplied and which would be included as part of a submission for a professional qualification. When it eventually arrived it was for a totally different subject - topic had not been specified precisely enough.

Now there's interesting we both have the same karma now....

Plus or minus a bit.   ;)
