Teachers are in a position of trust, and part of that trust means that they dont sleep with their pupils regardless of their age. Its not an anomaly for crying out loud, its to protect children of all ages. With your argument you could have teachers who offer better grades to pupils who sleep with them and they dont get prosecuted because it would be 'consensual' on the part of the pupil.   Banghead

NASUWT general secretary Chris Keates said it was an "anomaly" that a teacher who had sex with a pupil aged over 16 could go on the sex offenders register.

She told ITV's Tonight programme the law was wrong because a teacher could legally enter a relationship with a sixth former at another school.

Child protection professionals have criticised her comments.

In 2001, the law was changed to make it illegal for teachers to engage in sexual activity with pupils at their school aged under 18.

But Miss Keates said the abuse of trust law had gone too far in cases where the relationship started after a pupil had reached the age of consent.

She said: "If a teacher has a relationship with a pupil at the school at which they teach, it could be an 18-year-old pupil in sixth form, then that teacher can be prosecuted and end up on the sex offenders register.

"Clearly there have to be appropriate disciplinary sanctions in the school where a teacher works to make sure that inappropriate relationships don't develop.

"But it does seem a step too far, when there has been a consensual relationship, to put that person on the sex offenders register when, in fact, they could have a perfectly legitimate relationship with an 18-year-old at another school."

The important word there is ANOTHER you dozy tart. As in not someone under that teacher's care!!

"Any teacher or adult who works in schools who sexually abuses a pupil of any age should face the full legal consequences," she added.

Since 1991, 129 teachers have been prosecuted for relationships with pupils but a Sheffield University study suggested as many as 1,500 intimate relationships develop every year.

NSPCC policy advisor Zoe Hilton said: "The law is very clear that if a teacher abuses his or her position by forming a sexual relationship with a pupil they could be prosecuted and this remains the case even if the child gives their consent.

"The law is, quite rightly, there to protect children."

The union should sack her immediately, or whatever it is the unions do when they need to get rid of morons lke this.

The crux of the matter is that teachers are in a position of influence whereby they can bring pressure to bear on their charges thus whilst the sexual activity may well be between two people over the "age of consent" the consent from the pupil may well be given only after inappropriate influence has been exerted by the teacher and would not therefore be informed consent but rather coerced consent.

I heard this being debated on the radio earlier and the union idiot was back peddling furiously and saying that any sex between a teacher and a pupil, no matter what the age, should still be a matter over which the teacher should lose their job and not be allowed to teach again EVER but they should not be placed on the sex offenders register.
I used to have a handle on life but it broke.

Of course they should go on the register, if they are willing to abuse a position of trust in that manner then they are a danger to children. Having them registered stops then from being able to work in another school if they manage to get a chance again.

List 99 stops them from teaching anyway.
The Sex Offenders record is a useless piece of legislation that stops no-one because no school has access to it.
The only way schools have of checking is either through the CRB or List 99
