I know there is probably a thread somewhere else on this but this is just feckin' insulting. This poor bugger was tied up along with his family by three scroted who broke in and tried to rob the place. If they hadn't been light fingered bastards then he wouldnt have gotten free and banjoed his with a cricket bat. How the hell can you deny him leave to appeal. Was he out on the streets looking for someone to whack over the head? No, he was defencing his home and his family. This is just another example of the absolute abortion this country has been turned into by the government.

Munir Hussain, 53, was sentenced to 30 months for grievous bodily harm with intent after he hit one of three intruders with a cricket bat, in 2008.

Hussain and his family had been tied up at their home in High Wycombe, Bucks.

His brother, Tokeer Hussain, was granted leave to appeal against his conviction but it was later dismissed.

He was jailed for 39 months for the attack after both men were found guilty following a trial last year.

The brothers, who both lived in Desborough Road, chased intruder Walid Salem, leaving him with a permanent brain injury after he was hit with a cricket bat so hard that it broke into three pieces.

Salem was the only intruder caught after the incident on 3 September, but his injuries meant he was not fit to plead after being charged with false imprisonment.

Salem was given a two-year supervision order at a court hearing in September.

It is a sad state of affairs...  noooo:

I suspect that none of us living here in the real world would have let Salem off with anything less...

And needless to say, having 'solved' the case by making an arrest no effort has been wasted trying to find Salem's accomplices....

So is the tide finally turning in favour of those who fight back against burglars and other criminals? By showing 'mercy' to Munir Hussain, and suspending his jail sentence, the Lord Chief Justice certainly appeared to be delivering a victory for common sense.

But Lord Judge was very careful not to set any precedent with his decision to free Mr Hussain, saying the case was one of 'true exceptionality'.

He was also at great pains to stress how Mr Hussain had acted in hot blood, and was a man of extremely good character. It was not - said the judge - a case about a homeowner's right to tackle a burglar.

Rather, it was all about the extreme provocation Mr Hussain had suffered - not least in the threats to kill his family during a 'terrifying ordeal' at the hands of those who broke into his home.

To reinforce this point Mr Hussain's brother Tokeer - who was not present during the burglary, but took part in the attack upon Walid Salem - was told he must remain in jail, as he had not suffered the same provocation.


God forbid that we react too spontaneously and change any laws without  due process  ::)

I believe that the intruder was left brain damaged after Munir Husssains assult on him, so bloody brain damaged that he went on to commit more crimes. thatsit: Explode:  Bless him.
I have always thought that the worst thing about drowning was having to call 'help!' You must look such a fool. It's put me against drowning.
