Calling in the Bailliffs? Consumer advice....
« on: October 09, 2007, 01:24:37 PM »
Just wondering...if I buy something in a private sale, for the sake of the argument let's say it's a car, and the ad doesn't specifically state "includes steering wheel". If it then turns up and doesn't have a steering wheel, am I perfectly entitled to demand the seller sends me it before I go round there (obviously in another car) and stamp on his cock?

It's a long story but some Manc git sold me a gadget for £540 and when we met at a motorway services week gone Sunday to exchange, he had conveniently "forgotten" a couple of important parts that ship with the gadget as-new and would cost me £30 each to replace. Despite promising to "send them ASAP" and having them "all packed up", he still hadn't sent them by the time the postal strikes kicked off last Thursday. Due to the weight of the items, he would be better off sending them by a courier, who of course won't be on strike, so I figure he has no excuse.

To send in the bailiffs you first need to obtain a County Court Judgment against the seller and then he has to fail to pay the CCJ. Only then can you ask for the court appointed bailiff to visit him.
"Sending the boys round" is of course illegal ~ but if he is a trader in Manchester he will be well used to that and probably has "boys" of his own.
Would seem to me that you have been well and truly "taken".
Caveat Emptor and all that.

Unfortunately, judging by the state of this country today, that would probably result in him getting a promotion  cry:
"Political Correctness is a doctrine fostered by a delusional, illogical minority, and rabidly promoted by an unscrupulous mainstream media, which holds forth the proposition that it is entirely possible to pick up a turd by the clean end."

Well, someone had to say it!

Looks like I was prematurely unfair on the bloke, I received the parts by DHL at 6 o'clock this evening. Pity it took him 10 days to send them like cussing:
