This wasnt criminal damage, this was an act that could have killed or seriously injured a hell of a lot of people.
Lets be honest here, if he had belted the driver so hard that he ended up in this state:
He would have been put away for GBH. The fact that his actions could have had more serious consequences should be taken into consideration and his sentence instead of being cut.
A youth who dropped masonry from a bridge shattering a train's windscreen and hitting the driver of a separate train has had his prison sentence cut.
Daniel Ratcliffe, 17, of Broad Street, Kidderminster, Worcs, was sentenced to seven-and-a-half years in December after admitting criminal damage.
However, his lawyers argued his sentence for dropping the 45lb (20kg) brickwork slab had been "excessive".
The Court of Appeal agreed and shortened the term to six years.
Laughing and joking
Kevin Clee, 19, of Grasmere Close, Kidderminster, also admitted the attack and was jailed for six years.
The court heard how the slab had "bounced off" a passenger train and onto the cab of a freight train, which was being driven by 56-year-old Joseph Paxton, from Perry Barr, Birmingham.
Mr Paxton was left unconscious and suffered serious head and chest injuries.
Previously, the court hearing heard how the pair were seen laughing and joking shortly after dropping the masonry.
