The car's been GOT.

Gatso'd, and N.I.P received. cussing:

Now as some of you may know, I'm NOT one for turning over and having my tummy tickled, so I've written to them, by recorded delivery today, minus my signature of 'guilt', demanding positive identification by means of photographic evidence as to WHO was exactly driving said GROWLER mobile at the given time of persecution, as both myself and Mrs GROWLER were driving the car that day, and I cannot for the life of me remember who was driving it or when on that day, or in fact if either of us were.

I'm fully expecting zero response to my request, and therefore look forward to my day in court with t'he beak' to ask HIM if he knows?
I shall be using GROWLER and GROWLER no positive proof? No blame, solicitors to defend us.

Should be an interesting day out, and I'll try not to exceed 37mph en route. ::)

I'm actually quite looking forward to this tbh, as I'm fully expecting the 'snap' to prove inconclusive....IF received.... in its identification of driver of the moment, seeing as it's a GATSO that only takes a picture of the back of the car. rubschin:

If I'm found guilty, which I no doubt will be, I shall be asking serious questions regarding the law, and how someone can actually be found guilty of an offence without positive and wholesome proof.

Brussels trip in anticipation anyone? ::)

Indeed and then denied lying.
Personally, as I said at the time, I still think the poor woman put her hands up to the offence for the sake of some peace and quiet in the home.

In UK law, you cannot convict someone of crime or offence if it can't be proven, and I'll see them all in hell if they try that bloody tactic.
I'd do porridge before paying a fine if they simply decided it was me without positive evidence

DS is right ~ the owner of the vehicle has a legal duty to disclose who was driving ~ it was his alleged inability to remember that was Dippy's defense as he said he was not prepared to sign a statement that he was not 100% certain about. He argued that to do so would be perjury but in the end wiser heads prevailed. He is (or was, last I heard) still arguing that he was right but a fine was levied against his wife none the less.
His "defence" has been taken all the way by others without success and many a lawyer has added to his bank balance by arguing that, in British Law, no-one can be required to incriminate themselves ~ however I believe the Lords ruled that in this case they can be so required and penalised if they refuse.
One way or another they have the motorist by the grollies and they won't let go. At the moment you have received the Notice of Intention to Prosecute. Have they asked who was driving? That's how they will get you in the end.

Yes. NIP received and retained. Letter sent by recorded delivery yesterday stating that I cannot be absolutely 100% certain who was actually driving my car at that moment in time, as we both drove it that day, and unfortunately we don't keep a timed log of our movements.

If and when it goes to court, and unless they can prove it was either me or Mrs G that drove through the scamera at 37 mph, I'll be pleading not guilty as will Mrs G.

As I say Good Luck ~ unfortunately I suspect that many of us would pay up rather than go to court because of the way the courts always seem to double the fine and add costs, making a £60 + three points into a £200 grab at your wallet and/or assets. The longer one fights, it seems, the costlier it gets.

Meanwhile people are being robbed, murdered, raped, assaulted and made to live in fear because of the numbers of staff involved in processing a simple matter of a couple of miles an hour over a needless limit.
